Terms of service

MemberPulse is operated by Tek Hubs LLC (“we”). These terms apply to anyone who signs in to MemberPulse. By using it you agree to them.
The service
MemberPulse shows a studio's owners and directors their leads, members, marketing and reviews, drawn from the services the studio connects, and drafts replies for the studio to review. Suggestions, profiles and drafts are written with an AI model and can be wrong; check them before acting on them. It is provided as is; we work to keep it accurate and available but cannot guarantee that every figure is complete or that the service is never interrupted.
Your account and your studio
- Sign in only with your own Google account, and only for a studio you own or direct.
- Connect only services your studio has the right to use, and only with your own sign-in for them.
- You are responsible for anything you send to your leads and members, including drafts MemberPulse wrote for you.
Your data
Your studio's data remains yours. We use it only to provide MemberPulse to your studio, as described in the privacy policy and the data processing terms below.
Data processing terms
This section is the data processing agreement between your studio and us. It covers the personal information MemberPulse handles for your studio, and where anything else in these terms disagrees with it, this section wins. By connecting a service to MemberPulse, your studio's owner agrees to it on the studio's behalf.
Who decides, and who processes
Your studio decides why and how its leads', members' and team's information is used: it is the controller (a “business” under California law and a “regulated entity” under Washington's My Health My Data Act). We process that information on your studio's behalf, as its processor (its “service provider” under California law, and its “processor” under the My Health My Data Act).
What we process, and why
- Whose: your studio's leads and members, and the owners and directors who sign in.
- What: names and contact details; memberships, bookings and visits; conversations with your studio (texts, emails, and call transcripts where your studio records calls); what people tell your studio about their goals, their health and their injuries; and how your team uses MemberPulse.
- Why: only to provide MemberPulse to your studio: its dashboard, its suggestions and profiles, and the drafts it writes for your studio to review.
- For how long: until your studio's owner asks us to delete it, as the privacy policy describes.
What we promise
- Your instructions only. We process your studio's information only to provide MemberPulse, as these terms, your studio's settings and its owners' written requests direct. If we believe an instruction breaks the law, we will tell you rather than follow it.
- No other use. We never sell or share your studio's information, never use it for advertising, never let an AI provider train its models on it, and never use it for anything except providing MemberPulse. We do not combine it with another studio's information, except as statistics that identify no one (such as how often leads go on to join).
- Confidentiality. Only the people who run MemberPulse can reach it, they are bound to keep it confidential, and they look at it only to run, fix or support MemberPulse for your studio.
- Security. Your studio's information is stored in the United States, it travels encrypted, sign-ins for connected services are encrypted before they are stored, and every request is checked against who may see your studio.
- Our providers. The companies that process information for us are listed in the privacy policy. Each is bound to protect it at least as these terms do. We will tell your studio's owners before we add or replace one; if your studio objects, it can stop using MemberPulse and have its data deleted.
- Requests from people. If a lead or member asks us about their information, we will send them to your studio. We will help your studio answer requests to see, correct or delete someone's information.
- Breaches. If we learn that your studio's information has been reached by someone who should not have it, we will tell your studio's owners without undue delay, and within 72 hours of confirming it, with what we know and what we are doing about it.
- Health information. We treat what people tell your studio about their health and injuries as consumer health data under Washington's My Health My Data Act, and process it only as this section allows.
- Deletion. When your studio's owner asks, we delete your studio's information within 30 days and tell them when it is done.
- Showing our work. We will answer your studio's reasonable written questions about how we protect its information, and give it what it reasonably needs to see that we keep these terms.
What your studio promises
- It has the right to give us its leads', members' and team's information for these purposes, and to connect each service it connects.
- It has told its leads and members how their information is used, including that an AI model helps draft replies to them, and has any consent the law requires, including consent to collect and share consumer health data.
- It will tell us when someone has asked it to delete information MemberPulse holds, so we can delete it too.
Membership and payment
Each studio gets one free week, which starts when its dashboard first opens: the day both its Alloy Ops and its Mindbody are connected (a Mindbody site's owner approves MemberPulse's access; for an Alloy studio, that is Alloy corporate). After that, the dashboard stays on while the studio has a paid membership, or while we have agreed in writing that it is free. Payment is handled by Stripe. You can cancel at any time from Settings › Membership; the dashboard stays on until the end of the period already paid for. While a dashboard is closed, MemberPulse stops reading the studio's services; nothing already stored is lost.
Ending use
You can stop using MemberPulse and disconnect your services at any time. Stopping doesn't delete your studio's data: we keep it until an owner asks us to delete it, as the privacy policy describes. We may suspend access that breaks these terms or puts other studios' data at risk.
Liability
To the extent the law allows, MemberPulse is not liable for indirect or consequential losses, and its total liability is limited to what your studio paid in the three months before the claim.
Changes
